What is a Law Guardian?

  • A Law Guardian is appointed when the parties are unable to decide on Custody or Access of the Children
  • A modern term for this individual is an Attorney for the Children
  • This Attorney will sit down with the Child, examine and investigate both households, then come back to the courthouse with recommendations
  • If the child is old enough, and able to express their desires, these recommendations have to meet that of the Child
  • If the child is too young to express their desires, the Law Guardian will have some discretion in bringing issues to the Court
