When I meet with a client, one of the issues that we discuss all the time is the issue of divorce attorney fees. Our office generally requires a retainer. That retainer depends upon the circumstances of the parties. For instance, if I’m dealing with a party who has not been working, who is not the monied spouse, oftentimes we’re able to go after the monied spouse in the format of an order to show cause for a contribution toward legal fees.
If I’m dealing with the party who has the funds, is working, and is capable of providing a legal fee, we require a retainer, and that retainer is determined by the complexity of the case. When we sit down, we’ll go over the facts and circumstances and make a determination as to what’s reasonable, what’s affordable, and how we can move forward with the matter.
