Child support income is not taxable income – not federal, not state. Maintenance, however, is taxable income. Oftentimes, when we’re working out a property settlement or separation agreement, we may try to transfer some of the impact that taxes will have by allowing for a higher maintenance and a lower child support allotment. This allows both parties to come to an agreement and neither party to suffer financially as a result of it.
