The courts will generally take into consideration a number of different factors. As an experienced Buffalo Divorce Attorney, I have seen situations where a party has had three children, two of them have gone to college, and the parents have paid for them. That means that third child in all likelihood is going to get paid for also; as far as college expenses are concerned.
If you have a situation where mom or dad have gone to college themselves and have degrees; it could have been expected that had they remain together, the children would have done the same thing. The courts are likely to impose college educational expenses for the children in a situation like this. For the most part I don’t have parents fighting about college education expenses so long as both of them are contributing to it.
I tell people, “It’s always good to keep the noncustodial parent vested in the child or the children.” That person is important to that child or children. The noncustodial parent is going to want to do more, and provide more with the child if there is that connection.
