As an experienced Buffalo Divorce Attorney, clients often ask me about getting a prenup. Prenuptial agreements have their place, and they are legally enforceable contracts in New York State. They have to be prepared with both parties having full and open access to the financial circumstances of one another. It has to be shared, and that’s usually done by exchanging financial affidavits and documentation supporting that. Each party needs to be represented by their own attorney.
The most important aspects of a prenuptial agreement would be deciding what assets are going to remain separate property, and what assets, moving forward, are going to be considered to be marital property subject to equitable distribution. As a Buffalo Divorce Attorney, I would say that prenuptial agreements are important for people, who have a lot of assets as well as people who are older in age and would like to see that the things that they have accumulated are going to go to their side of the family, as opposed to their new spouse’s side of the family.
