Buffalo Divorce Lawyer Discusses How Long You Must Live in a State Prior to Filing for Separation

As an experienced Buffalo Divorce Lawyer, clients often ask me about how long they must live in New York before they can file for separation. Generally speaking, residency in New York is for a two-year period of time. If you were married in New York, then it’s for a one-year period of time. If all parties are living in New York State at the time of the commencement of the action, then we have jurisdiction, even though you may not have been here for a period of one year.
If the marriage, in your mind, has been irretrievable broken for a period of six months, and it accrues in New York State, then we may have jurisdiction over that.
