As an experienced Buffalo Divorce Lawyer I am often asked by clients about whether or not they should open up a separate bank account. Generally speaking, that’s not something that we recommend. When an action for divorce is initiated, that summons is accompanied by a status quo order. This means that the parties are to maintain the status quo as far as their financial situation is concerned. How they maintain and keep the household, the children, that’s not to be changed.
If you open up a separate account it almost automatically goes against the status quo order. This may not be inappropriate or in violation of the status quo order, but it would not be looked kindly upon by the courts.
