You don’t need a separation agreement in order to get a divorce. Oftentimes the parties will enter into an agreement so that they can set forth specifically the distribution of their assets. In some situations, there may be so few assets or so few things being contested that we’re simply able to put together a short stipulation and have that incorporated into a judgment of divorce. If you anticipate that the divorce is going to be uncontested, then the court will have to make a determination as to what is equitable between the parties. We provide affidavits and documentation to the court supporting what it is or how it is that we think the property should be equitably divided between the parties.
