When a client first initiates an action for divorce, oftentimes the husband or the wife will ask me, “What should I do now? Should I tell my wife or should I tell my husband that I’m going to be initiating a divorce?” My response is always very consistent. “It depends”. It depends on whether or not you can do so in a manner in which the situation can be discussed reasonably without there being a confrontation.
If there’s going to be a confrontation, then the answer is no. Let us go ahead and send out a letter, let the individual get an attorney, let me deal with their attorney in regards to the service of the summons and the complaint. If the parties are able or feel that they’re going to be able to discuss the matter (generally speaking both parties already have an idea that a divorce is going to be proceeding anyway) then it’s fine. Go ahead and let the individual know that they’re going to be receiving a letter or that they’re going to be receiving a summons so there isn’t any real upset when it does happen and we can deal with it.
