If you find that a tenant is intentionally damaging your property, it is possible to actually bring criminal charges against that tenant. However, you have to be able to show to the police and to the district attorney’s office that it was that tenant actually doing the damages. A notice to the tenant of the situation, an explanation written from the tenant as to what occurred and then a decision as to whether or not you’re going to go to criminal court or evict the tenant. That’s something that you’re going to want to discuss with your attorney.
