As an experienced Buffalo, NY Divorce Lawyer, I often have clients ask me what is important for them to know about child support during a divorce.
In New York State, child support is regulated by the New York State Child Support Standards Act, and generally speaking, the custodial parent is going to be entitled to, if there is one child: 17 percent, minus the FICA, federal withholding would rate down a 7.6 percent and varies from time to time. 17 percent for a one child, 25 percent for two children, 29 for three and it goes on upward from there.
Child support is defined by statute in New York State, it’s not generally left to discretion of a judge or anyone else for that matter. It’s pretty much a given aspect of what you’re going to be entitled to.
